§ 81-27. Stop-work orders.

A.Whenever the Director of the Division of Environmental Protection or the designee of the Director has reasonable grounds to believe that a regulated activity as described in § 81-4 of this code is being performed: (i) in violation of the provisions of the applicable codes or regulations; or (ii) not in conformity with the provision of an application, plans, specifications or other documents upon the basis of which a permit was issued; he shall notify the owner of the property or the owner's agent or the person performing the work to suspend all work, and any such persons shall forthwith stop such work and suspend all regulated activities until the stop-work order has been rescinded. Such order and notice shall be in writing, shall state the conditions under which the work may be resumed and may be served upon a person to whom it is directed either by delivering it personally to him or by posting the same upon a conspicuous portion of the primary structure, or the project site, or the structure under construction, and sending a copy of the same by certified mail to the property owner.B.It shall be a violation to allow or cause to be continued a regulated activity on the subject premises after the issuance of a stop-work order pursuant to this chapter.C.A stop-work order may be rescinded only by the Director or his designee upon evidence of compliance with this chapter.
