§ 85-90. Extension of time for implementation.

  • A. 
    Upon application to the Commissioner of Planning, Environment and Land Management seeking an extension of time limits effectuating any change of zone or special permit condition of approval or restrictive covenant, the Commissioner may grant a maximum of two extensions, not to exceed one year each, subject to the applicant sufficiently demonstrating that:
    (1) 
    The applicant is diligently pursuing all other required governmental permits and approvals.
    (2) 
    There are valid pending applications before such governmental agencies and the applicant is awaiting a determination from such other governmental agencies.
    (3) 
    The extension request is made prior to the expiration of the approval.
    B. 
    Should an extension be granted for an application regarding a covenant and restriction, such approval shall be so granted upon the condition that said letter of approval be filed as an addendum or its equivalent to the originally filed covenants and restrictions in the Suffolk County Clerk's Office.
