§ SR-8. Procedure.

  • A. 
    Submission of a final plan, before the Planning Board review, shall consist of the following items:
    (1) 
    An application for final plat approval, together with a filing fee as established by Town Board resolution.
    (2) 
    The final plat, six paper prints, including signed approval from the Suffolk County Department of Health.
    (3) 
    A final drainage plan and street profiles.
    (4) 
    Letters directed to the Chairman of the Planning Board and signed by a responsible official of the lighting agency, water company or any utility company or governmental authority which provides necessary utility service and has jurisdiction in the area approving each proposed utility installation design and a statement as to who will construct the facility.
    (5) 
    A letter directed to the Chairman of the Planning Board signed by a responsible official of the school district in which the subdivision is to be located acknowledging receipt of the subdivision plans.
    (6) 
    Dedication and easements:
    (a) 
    Deeds of dedication, surveys and a certificate of title, properly executed, for all properties, other than street rights-of-way, to be offered to the Town for dedication.
    (b) 
    Release and dedication of streets, application to lay out streets, proposed order of the Superintendent of Highways and proposed consent of the Town Board, all in triplicate and drawn in accordance with the provisions of § 171 of the Highway Law.
    (c) 
    Drainage easements.
    (d) 
    Easements of limited access and planting area. (Street dedication instruments are to be offered at the time of performance bond approval.)
    (e) 
    An easement permitting any cable television firm franchised by the Town of Brookhaven the right to install coaxial cable trunk distribution lines for cablevision, together with the necessary electronic equipment, without charge, provided that such installation is made in the same manner and at the same time as the installation of electric and telephone distribution lines. Such easement shall be effective immediately upon the filing of the map in the office of the Suffolk County Clerk and prior to the acceptance of the public improvements by the Town of Brookhaven. Such casements shall be in a form authorized by the Planning Board and approved by the Town Attorney.
    B. 
    The subdivider or his agent shall submit the final plat and supporting drawings and documents to the Planning Board office at least 15 days prior to the meeting date on which the plat is to be acted upon.
    C. 
    The Planning Board shall advertise a public hearing at least 10 days prior to the hearing date. The subdivider shall notify all adjoining owners at least 10 days before the public hearing and file with the Planning Board an affidavit giving the names of those notified and the date such notices were mailed.

    D. 
    After the public hearing, the Planning Board shall take formal action. If the plat is approved, the subdivider shall carry out the following steps prior to obtaining the Chairman's signature of approval:
    (1) 
    He shall make all required corrections to the satisfaction of the Planning Board.
    (2) 
    He shall submit the required performance bond to the Planning Board for checking and forwarding to the Town Board for approval.
    (3) 
    He shall pay the required inspection fee to the Planning Board and such payment, if required, in lieu of parklands.
    (4) 
    He shall prepare prints of the corrected final plat drawings as follows:
    (a) 
    Eight paper prints.
    (b) 
    Three opaque cloth litho prints; only one print shall be required on subdivisions already filed.
    (c) 
    One tracing cloth litho print.
    (d) 
    The original drawing.
    (e) 
    Three paper prints and the original of the corrected drainage plans and street profiles.
    (f) 
    One photographic reduction of the final plat on a scale of one inch equals 1,000 feet and one photographic reduction of the final plat on a scale of one inch equals 1,200 feet.
    E. 
    The subdivider shall file three opaque prints of the signed plat, not including the supporting drawings and documents, in the Suffolk County Clerk's office.
    F. 
    Planning Board approval of a final plat shall not be deemed an acceptance by the Town of any street or other land shown as offered for dedication to public use.
