§ 67-40. Penalties for offenses.

  • A. 
    Any person or persons, associations, corporations or entities committing an offense against this chapter or any section or provision thereof is guilty of a violation punishable by a fine as indicated hereinbelow or imprisonment for a period not to exceed 15 days, or by both fine and imprisonment, and each day's continued violation shall constitute a separate offense:
    (1) 
    First offense: not less than $500.
    (2) 
    Second offense: not less than $1,000.
    (3) 
    Third offense: not less than $1,500, and additionally, in the case of vehicle operators, revocation of permit for a minimum of one year, after which reinstatement shall be based on a complete new application process, including fingerprints.
    B. 
    In addition to any other remedy provided by law, the Town may bring an injunction proceeding to enforce this chapter.
    C. 
    Notwithstanding conviction for a violation hereunder, and imposition of a fine and/or imprisonment therefor, any license, certificate or permit holder shall also be liable to suspension, revocation or future disapproval of any license, certificate or permit held by him or her in his or her own or any business or corporate name for offense against this chapter. The provisions contained in this chapter regarding disapproval, suspension and revocation shall be controlling to effectuate any disapproval, suspension or revocation provided for herein.
